Payments and Billing

We accept major credit cards. Virtual credit cards and gift cards typically will not be accepted. Other forms of payment may be arranged by contacting us through the contact form at: https://picsenhancer.com/contact.

Please note that any payment terms presented to you in using or signing up for paid Services are deemed part of this Agreement.

We use third-party payment processors (the "Payment Processors") to bill you through a payment account linked to your Account on the Services (your "Billing Account") for use of the paid Services. The processing of payments may be subject to the terms, conditions, and privacy policies of the Payment Processors in addition to this Agreement. We are not responsible for errors by the Payment Processors. By choosing to use paid Services, you agree to pay us, through the Payment Processors, all charges at the prices then in effect for any use of such paid Services per the applicable payment terms and you authorize us, through the Payment Processors, to charge your chosen payment provider (your "Payment Method"). You agree to make payment using that selected Payment Method. We reserve the right to correct any errors or mistakes even if it has already requested or received payment.

You can modify your paid plan level anytime during the period. Changes in plan level will occur immediately. The features of the new plan will be immediately accessible. If you choose to upgrade your plan level you'll be refunded for the number of days you haven't used on the previous plan and will be charged for the corresponding days on the new plan. If you choose to downgrade the plan level we will bill you for the full price of the new (lower) plan level.

You can also cancel your subscription at any time you want

Cancellation

All purchases are non-refundable. You can cancel your subscription at any time in your account settings, or by contacting us using the contact information provided below. Your cancellation will take effect at the end of the current paid term.

You may cancel your plan or terminate your account at any time without cause, but you will not be entitled to any refunds of any prepaid and unused fees, and any unpaid fees under your Plan for the applicable subscription term will become immediately due and payable.

Pics Enhancer may restrict the functionality of the Site or temporarily suspend your account if we reasonably believe that you have violated these Terms. Unless we believe the need to restrict or suspend access is time-sensitive and requires immediate action without notice, or we are prohibited from providing notice under law or legal order, we will use commercially reasonable efforts to notify you by email prior to such suspension. We will not be liable to you or any third parties for any of the foregoing actions. We may terminate your account and use of the Site for any of the following reasons: (i) you fail to comply with these Terms, (ii) you do not pay your fees in accordance with the payment terms under your Plan, (iii) at the expiration of the subscription period of your Plan if we provide prior written notice to you, (iv) you become the subject of a petition in bankruptcy or any other proceeding relating to insolvency, receivership, liquidation or assignment for the benefit of creditors, or (v) if we reasonably determine you are acting or have acted in a way that could present substantial reputational harm to Pics Enhancer or our current or prospective partners or customers. In no event will any termination by us for the foregoing reasons entitle you to any refunds of any prepaid and unused fees or relieve you of your obligation to pay any fees payable to us before the date of termination, and any unpaid fees under your Plan will become immediately due and payable. Any suspected fraudulent, abusive, hateful, discriminatory, or illegal activity may be grounds for immediate termination of your use of the Product and may be referred to law enforcement authorities.

Suspension or Termination

These Terms of Use shall remain in full force and effect while you use the services of Pics Enhancer. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION.

WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

We reserve the right to suspend or deactivate your Account or your access to certain aspects or all of the Services or to terminate these Terms, at our sole discretion, at any time and without notice or liability to you.
